The Night With… – Fair Work Statement
The Night With… is committed to uphold the values of Fair Work in all of our activities. We want our organisation to be a place where our employees, freelancers and participants feel welcomed, supported and engaged in what we do.
Following the Fair Work Framework, we have outlined how we are embedding Fair Work practises into our organisation.
EFFECTIVE VOICE
The Night With… already has a variety of established channels for dialogue which are regularly used by everyone we work with, and we actively encourage everyone to contribute their views, both formally and informally. These have proven to be effective, and the views, ideas and challenges expressed are given serious consideration and included in our decision making (for instance, when commissioning, scheduling, and determining contractual matters), pointing to a respectful company culture that embraces a wide diversity of viewpoints. The Musician’s Union is fully recognised.

OPPORTUNITY
We aim to make employment, freelance and artistic opportunities accessible to people from a wide range of backgrounds.
Recruitment information will clearly set out the fee or salary, expected workload, contract status and principal responsibilities of the role. We will make reasonable adjustments to recruitment processes and working arrangements and will consider applications in alternative formats where appropriate.
We use open calls and transparent selection criteria where these are suitable for the opportunity. We regularly review who is represented within our programmes and consider how barriers to participation and career development can be reduced.
The Night With… invests in the development of composers, performers, sound engineers and other creative practitioners through paid commissions, workshops, mentoring, training and structured development opportunities. We do not offer unpaid internships or expect people to undertake substantial unpaid trial work.
SECURITY
The Night With… is committed to clear contracts, fair rates of pay and reliable working arrangements.
We pay at least the current Real Living Wage and use relevant Union or recognised industry rates for musicians and other freelance creative practitioners where these apply. We periodically review rates against changes in the cost of living and wider industry practice.
Everyone receives written information setting out the work required, the agreed fee or salary, anticipated hours or dates, payment arrangements and other relevant conditions. Freelancers are paid for the work required of them, including preparation, rehearsals, meetings and performances where these form part of the engagement.
We do not use zero-hours contracts. We aim to confirm schedules with as much notice as possible and to pay invoices and expenses within the agreed payment period.
The Night With… is committed to never using dismissal and re-engagement, commonly known as “fire and rehire”, to impose less favourable terms and conditions.
FULFILMENT
We know that the work of The Night With… is artistically and professionally rewarding.
Our working culture is based on trust and collaboration. Staff and freelancers are given appropriate autonomy over how they undertake their work, alongside clear responsibilities, deadlines and support.
We discuss professional development and support relevant training, mentoring and skills development where resources allow. Our artistic and development programmes provide composers, performers and technicians with opportunities to experiment, develop their practice and build sustainable professional relationships.
We aim to create an environment in which people’s skills are recognised and their contribution is properly credited. Feedback is encouraged throughout projects so that difficulties can be addressed and working practices improved. An annual review of all regular contractors is conducted appropriate to their work.
RESPECT
Everyone working with The Night With… has the right to be treated with dignity and respect.
We do not tolerate discrimination, bullying, harassment, sexual harassment, victimisation or intimidating behaviour. This applies to all interactions between representatives of The Night With…, artists, trustees, participants, partners, venue staff and audience members.
We are committed to equality regardless of age, disability, gender reassignment, marriage or civil partnership, pregnancy or maternity, race, religion or belief, sex or sexual orientation. We also recognise the barriers that can arise through socioeconomic background, geography, caring responsibilities and unequal access to education or professional networks.
Flexible working is the norm. This includes home or hybrid working, flexibility around working hours and reasonable adjustments connected with disability, health or caring responsibilities. We recognise that evening, weekend and touring work is often necessary within live music and take this into account when planning schedules and workloads.
We regularly consider risks relating to health, safety and wellbeing in our workplaces, rehearsals, performances, recording sessions and tours. Workers are encouraged to raise any access, safety or wellbeing concerns so that appropriate action can be taken.
